CONVENTION COLLECTIVE DE L'IMMOBILIER
* Arrêté du 20 novembre 2014 portant extension de l'avenant n° 62 du 1er juillet 2014, relatif
au travail à temps partiel
Étendu par un arrêté publié au Journal Officiel du 27 novembre 2014, l'avenant n° 62 du 1er juillet 2014 relatif au
temps partiel dans la branche de l'immobilier est entré en vigueur au 28 novembre 2014. Cet avenant vient fixer,
de façon limitée, les possibilités de dérogation à la durée minimale hebdomadaire obligatoire de 24 heures.
1) DURÉE MINIMALE DES CONTRATS DE TRAVAIL À TEMPS PARTIEL
a) Dérogations conventionnelles à la durée minimale légale
Les dérogations à la durée hebdomadaire minimale obligatoire de 24 heures pour les salariés à temps partiel sont
fixées en fonction du secteur d'activité et de la nature du contrat :
- dans les secteurs d'activité des locations touristiques ou de courte durée, sont concernés :
› le ménage ;
› l'établissement des états des lieux ;
› l'accueil, la réception si ce service n'est pas assuré en continu.
- les contrats de travail à durée déterminée conclus pour le remplacement d'un salarié temporairement
absent ayant une durée inférieure à 24 heures.
Exemple
Vous souhaitez remplacer un salarié absent, dont le contrat de travail prévoit une durée de
17 heures hebdomadaires. La durée contractuelle hebdomadaire de travail du remplaçant
pourra être également de 17 heures, au lieu des 24 heures normalement applicables.
Dans ces 2 cas, limitativement énumérés, la durée minimale hebdomadaire
est fixée à 8 heures.
b) Garanties pour le salarié en cas de dérogation
Parmi les garanties qui doivent être mises en place en contrepartie de cette durée du travail hebdomadaire
inférieure à 24 heures, nous attirons votre attention sur 2 points :
