FINANCIAL HIGHLIGHTS Luxembourg News Luxembourg's Government measures for economic recovery On May 12, 2009, the Parliament voted on a set of measures proposed by the Government in March to stimulate economic recovery in the Grand Duchy and also the economic recovery for private enterprise : Law 6003 introduces a system of temporary aid to enterprises with financial difficulties (for instance the allocation of 500,000 aid from the State), Law 6004 initiates a temporary State guarantee system for loans granted by credit institutions to enterprises in difficulty, and Law 6005 promotes research and development (through extension and creation of new State allowance regimes, coordination with European R&D supporting legislation, and simplification of the administrative procedure for obtaining State allowances). More details: Memorial n°80/2009; www.rcsl.lu New VAT rules for cross-border supply of services Further to the adoption of two directives and one regulation known as "VAT package" by the ECOFIN Council on 12 February 2008, European businesses involved in cross-border provision of services within the European Union will have to review the VAT regime applicable to those services rendered. On 13 March 2009 the Luxembourg Government Council agreed on a set of rules intended to transpose this European legislation which will thus amend the current applicable "place of supply rules" for crossborder services, introduce new reporting requirements, as well as new procedures for VAT refund claims by EU businesses. More details: http://www.ey.com /LU/en/ Services/Tax/Indirect-Tax Implementation of European small claims procedure and European order for payment procedure into Luxembourg law The Law dated 13 March 2009 introduced two new European Council regulations into Luxembourg legislation: Council Regulation 861/2007 of 11 July 2007 establishing a European Small Claims Procedure which seeks to improve and simplify procedures in civil and commercial matters where the value of a claim does not exceed 2000 . G G Partial tax exemption for income from intellectual property The circular L.I.R. N ° 50bis / 1 of 5 March 2009 from the director of direct taxes analyses article 50bis L.I.R., applicable for the 2008 tax year, provides for partial tax exemption of income from intellectual property. The main points covered in the Circular are the following: Electronic filing and reform of the trade register 20 April 2009. The trade register simplified the filing procedure by implementing a special office for registration by the Registration Council Regulation 1896/2006 of 12 December 2006 creating a European order for payment procedure which allows creditors to recover their uncontested civil and commercial claims according to a uniform procedure that uses standard forms.
