AGENT COMMERCIAL
• L'agent commercial collaborateur non-salarié d'un agent immobilier n'a pas besoin de la carte professionnelle Un agent immobilier peut faire appel à des agents commerciaux pour exercer des activités de prospection immobilière pour son compte. Ces collaborateurs non-salariés de l'agent immobilier (soumis au statut des agents commerciaux) ont-ils besoin d'obtenir la carte professionnelle de transaction et de gestion Immobilière pour exercer leur activité? Non, les agents commerciaux ne sont pas soumis à l'obligation de solliciter la garantie financière exigée des agents Immobiliers; mais ils doivent justifier de l'attestation délivrée par l’agent immobilier. Ils ne peuvent détenir des sommes d'argent, des biens, des effets ou des valeurs et ils doivent respecter les obligations relatives à l'incapacité d'exercer des activités d'entremise et de gestion des Immeubles et fonds de commerce. • L'agent commercial déloyal est privé d'indemnité de fin de contrat Un arrêt récent illustre la notion de faute grave permettant au mandant de se dispenser d'indemniser son agent commercial à l'occasion de la rupture de son contrat. Dans cette affaire, une entreprise a rompu le contrat qui la liait à un agent commercial lui reprochant d'avoir distribué et été commissionné par une autre entreprise concurrente. L'agent a saisi la justice afin d'obtenir le versement de dommages et intérêts ainsi que d'une indemnité compensatrice de préavis. Il perd son procès : les juges considèrent que le comportement de l'agent commercial était constitutif d'une faute grave et en cela portait atteinte à la finalité commune du mandat d'intérêt commun, ce qui rend impossible le maintien du lien contractuel et exclut le bénéfice d'une indemnité compensatrice de préavis.
