783. Le système juridique accorde une valeur différente aux règles générales et aux règles spéciales. Si l’application du critère de spécialité, que résument les adages lex specialia generalibus derogant ou legi speciali per generalem non derogatur, peut donner l’impression que les règles spéciales l’emportent sur les règles générales en cas de conflit, en réalité, les règles générales sont très protégées au sein de la hiérarchie normative. 784. D’une part, afin de préserver les règles générales, le juge peut agir directement sur le critère de spécialité, soit sur son identification, en refusant de reconnaître l’existence de telle ou telle règle spéciale qui viendrait exclure l’application d’une règle générale, soit sur son régime, en reconnaissant l’existence d’une règle spéciale mais en refusant qu’elle exclue l’application de la règle générale (Chapitre 1). 785. D’autre part, si l’existence d’une règle spéciale est censée exclure l’application de la règle générale en vertu du critère de spécialité, ce dernier doit être combiné avec d’autres critères de hiérarchisation des normes : son champ d’application est donc borné par celui du critère organique et du critère matériel. En outre, la possibilité de déroger aux règles générales par des règles spéciales est limitée par les principes d’égalité et d’indivisibilité républicaine (Chapitre 2).
