Par exemple, au lieu de dresser une liste de noms, une loi d’amnistie peut viser « toutes les contraventions commises avant telle date », une règle peut prescrire l’expulsion immédiate de tous les habitants d’un immeuble situé à tel endroit. Les éléments spatio-temporels participent donc du caractère général des règles juridiques. 405. À la question « quelles sont les règles (absolument) générales ? », il est donc possible de répondre qu’il s’agit des règles juridiques dont les sujets et/ou les objets sont définis de façon abstraite, c’est-à-dire indépendamment des individus ou des choses concrètes auxquelles ils renvoient dans la réalité. 406. Se pose désormais la question de savoir quelle est l’utilité de qualifier telle ou telle règle de générale : pourquoi, au sein de l’ensemble des normes juridiques, différencier celles qui sont générales de celles qui ne le sont pas ? Au-delà de la dissertation sur ce que sont les règles générales, il importe donc de s’interroger sur l’intérêt de les distinguer des règles particulières.
